Legal information and terms applicable to Swiss Diving services.
GENERAL TERMS AND CONDITIONS OF SALE AND PARTICIPATION – SWISS DIVING
These terms and conditions apply to training courses, lessons, dives, introductory dives and other activities offered by Swiss Diving.
Registration for an activity implies acceptance of these terms and conditions.
1. Registration and Booking
A registration is considered confirmed once it has been approved by Swiss Diving and the required payment has been received.
As places are limited and training courses are primarily organised individually or in small groups, registration reserves specific time slots for the participant.
Swiss Diving reserves the right to refuse or postpone a registration if the conditions required to carry out the activity are not met.
2. Prices and Payment
The applicable prices are those displayed on the Swiss Diving website at the time of registration.
The services included in the price are specified in the description of each training course or activity.
Any additional costs or services not included in the price will be communicated to the participant before they are provided.
Unless otherwise agreed, payment must be made before the start of the training course or activity.
3. Family & Friends Rate
Swiss Diving offers a 5% discount per person for two or more participants registering together for the same training course and attending it on the same dates.
This discount allows families, couples and groups of friends to discover and enjoy diving together.
The discount cannot be combined with other promotions, special rates or offers unless otherwise agreed by Swiss Diving.
4. Cancellation by the Participant
Swiss Diving understands that unforeseen circumstances may arise. The following conditions are intended to provide flexibility for participants while taking into account the time slots reserved specifically for their training.
More than 14 days before the start of the activity: cancellation is possible free of charge. The participant may request a refund or reschedule their registration.
Between 7 and 14 days before the activity: the participant may reschedule the activity free of charge to a new date agreed with Swiss Diving.
Between 48 hours and 7 days before the activity: one rescheduling may be granted, subject to Swiss Diving's availability.
Less than 48 hours before the activity or in the event of a no-show: the scheduled session or activity will generally be considered due and payable.
In the event of illness, accident or another serious and unforeseen circumstance, Swiss Diving will endeavour, where reasonably possible, to find an appropriate solution with the participant.
Costs already incurred by Swiss Diving with third parties may nevertheless remain payable.
5. eLearning, Training Materials and Certifications
Some training courses include eLearning, training materials, certification or other services individually ordered for the participant from a training organisation such as PADI.
Once an eLearning course, certification or personal training material has been ordered, assigned or activated for the participant, its cost cannot be refunded if it is no longer refundable to Swiss Diving.
In the event of cancellation, the corresponding amount will therefore be deducted from any refund.
6. Cancellation or Rescheduling by Swiss Diving
The safety of participants is the priority.
Swiss Diving may modify, interrupt or postpone an activity if weather conditions, lake conditions, visibility, diving conditions, a technical issue, the health or safety of a participant, or any other circumstance makes the activity unsuitable.
When an activity is postponed by Swiss Diving for safety or organisational reasons, a new date will be offered to the participant at no additional cost.
Any decision made by the instructor or supervisor for safety reasons must be respected.
7. Late Arrival
Participants must arrive at the agreed time and bring any required personal equipment.
In the event of late arrival, Swiss Diving will make every reasonable effort to carry out the planned activity. However, the duration of the session may be reduced if subsequent activities cannot be delayed.
A significant delay that prevents the activity from taking place may be considered a no-show.
8. Medical Conditions
Scuba diving requires a state of health compatible with the activity.
Participants must complete all medical questionnaires and documents required for their training or activity fully and honestly.
When a medical certificate is required due to the answers provided on the medical questionnaire, the training course being undertaken or any other applicable requirement, the participant must provide it before taking part in the relevant activities.
Participants must inform Swiss Diving of any change in their health that could affect their safety while diving.
9. Prerequisites and Training Level
Participants are responsible for providing accurate information regarding their age, experience, certifications and diving level.
The prerequisites specified for each training course must be met before the course begins.
Swiss Diving may adapt the programme or postpone certain dives if the participant's technical level does not yet allow an exercise or dive to be carried out safely.
10. Participant Insurance
Each participant must have valid health and accident insurance appropriate to their personal situation and to the practice of scuba diving.
It is the participant's responsibility to ensure that their insurance provides sufficient coverage for the activity and, if necessary, to obtain additional coverage.
Any medical, rescue, transportation, hyperbaric chamber, hospitalisation or other personal expenses not covered by the participant's insurance remain the participant's responsibility.
11. Insurance of the Supervising Team
Members of the Swiss Diving team responsible for supervising activities have professional insurance coverage related to their diving activities, in particular through DAN (Divers Alert Network) or the FSSS (Swiss Underwater Sports Federation), depending on the coverage applicable to the individual instructor or supervisor.
This professional insurance does not replace the participant's personal insurance coverage.
12. Equipment Provided
Equipment provided or loaned by Swiss Diving must be used with care and in accordance with the instructions given by the instructor or supervisor.
Normal wear and tear, technical defects and damage resulting from normal and appropriate use of the equipment are not the participant's responsibility.
Any defect or damage identified must be reported to Swiss Diving immediately.
13. Damaged or Lost Equipment
In the event of loss or damage resulting from negligence, improper use or failure to follow instructions, the participant must immediately inform Swiss Diving.
Where the participant is responsible for the loss or damage, they are required to report the claim to their private third-party liability insurance.
Any insurance deductibles, as well as amounts not covered by the insurance, remain the participant's responsibility, up to the amount of the actual loss suffered by Swiss Diving.
Swiss Diving may request reimbursement of the actual repair costs. If the equipment cannot reasonably be repaired or has been lost, compensation corresponding to its appropriate replacement value may be requested.
14. Personal Equipment
Participants remain responsible for their personal equipment throughout the activity.
They must ensure that their equipment is in good working order and suitable for the planned dive.
Swiss Diving reserves the right to refuse the use of equipment considered unsuitable or presenting a safety risk.
15. Compliance with Instructions and Safety
Participants agree to follow the instructions given by the instructor or supervisor.
Swiss Diving may interrupt or refuse the participation of any person whose behaviour could compromise their own safety or the safety of other participants.
This includes, in particular, repeated failure to follow safety instructions or the consumption of alcohol, drugs or any substance incompatible with safe diving.
16. Interruption or Withdrawal from a Training Course
A diving course is based on the acquisition of skills and not solely on the completion of a predetermined number of sessions.
If additional sessions or dives are required to achieve the skills necessary for certification, Swiss Diving will inform the participant.
Any additional costs will be communicated and agreed upon before the additional sessions or dives take place.
If a participant voluntarily decides to withdraw from a training course that has already begun, services already provided and costs already incurred are non-refundable.
17. Certification
Payment for and participation in a training course does not automatically guarantee certification.
Certification is awarded when the participant meets the theoretical, practical and safety requirements established by the relevant training organisation.
Swiss Diving is committed to supporting participants throughout their learning process and enabling them to progress under appropriate and safe conditions.
18. Participants Under the Age of 18
Participants under the age of 18 must have the authorisation of their parent or legal guardian whenever such authorisation is required.
The age limits and specific conditions established by the relevant training organisation remain applicable.
19. Liability
Swiss Diving organises its activities in accordance with the safety rules and standards applicable to the training courses and activities offered.
Scuba diving nevertheless remains an activity involving inherent risks, which the participant acknowledges when registering.
These terms and conditions do not limit Swiss Diving's liability where such liability cannot legally be excluded or limited.
20. Personal Data
Personal data provided during registration is used for the organisation of training courses and activities, communication with participants, administrative management and, where necessary, registration with certification organisations.
Swiss Diving processes this information confidentially and in accordance with applicable data protection regulations.
21. Photos and Videos
Swiss Diving may take photographs or videos during its activities.
The use of identifiable images of a participant for communication or promotional purposes is subject to the participant's consent.
Participants may withdraw their consent for future use by contacting Swiss Diving.
22. Vouchers, Promotions and Special Offers
Vouchers, discounts, promotions and special offers are subject to the conditions specified when they are issued.
Unless otherwise stated, they cannot be combined with the Family & Friends rate or other discounts.
23. Amendments to These Terms and Conditions
Swiss Diving may amend these terms and conditions when necessary.
The terms and conditions applicable to a booking are those accepted at the time of registration.
24. Applicable Law
The contractual relationship with Swiss Diving is governed by Swiss law.
Any mandatory provisions of applicable law remain reserved.
